Statewide Transition Plans Update

CMS recently posted final approval for Arkansas and Kentucky transition plans, bringing the total to three states with final approved plans and more than half the states with initial approved plans. See

Lilly Hummel from NCAL recently learned through the grapevine that CMS is forming an internal work group with representatives from several states to start working on additional heightened scrutiny guidance. They have not yet begun meeting, which we're guessing means that guidance will not be released soon because it will take some time to create and go through the approval process. It sounds like their focus is to clarify what constitutes a setting that isolates, particularly in rural areas. It's unclear at this time whether new guidance will address issues around co-location or our other concerns. NCAL sent CMS a letter in mid-June with member concerns.
